CONDITIONS OF USE
Orchid of Siam provides their services to you subject to the following conditions. If you visit or purchase any services at Orchid of Siam you accept these conditions.
DEFINED TERMS
"Client" or "you" or "your" means the individual visa applicant visiting Orchid of Siam or using any of their services. The term Client refers to the visa applicant only and does not include any sponsor who may have paid for our services on behalf of the client.
"Profile" means the information provided by the Client about the Client and if applicable about his/her family.
"Service" means the Personalized Visa Service provided on behalf of Orchid of Siam. A detailed description of what is included in your Service can be found on our website.
"Terms" means these terms and conditions.
"Working Day" means a day on which banks are open for business in the UK.
“Web Site” means www.orchidofsiam.com
PRIVACY
All communications between Orchid of Siam and their clients are strictly confidential and will not be divulged to a third party unless required to do so by law.
No details of clients are stored on computers.
LICENSE AND SITE ACCESS
Orchid of Siam grants you a limited license to access and make personal use of this site and not to download (other than page caching) or modify it, or any portion of it, except with express written consent of Orchid of Siam. This license does not include any resale or commercial use of this site or its contents; any collection and use of any product listings, descriptions, or prices; any derivative use of this site or its contents; any downloading or copying of account information for the benefit of another merchant; or any use of data mining, robots, or similar data gathering and extraction tools. This site or any portion of this site may not be reproduced, duplicated, copied, sold, resold, visited, or otherwise exploited for any commercial purpose without express written consent of Orchid of Siam. You may not frame or utilize framing techniques to enclose any trademark, logo, or other proprietary information (including images, text, page layout, or form) of Orchid of Siam without express written consent. You may not use any Meta tags or any other "hidden text" utilizing Orchid of Siam’s name or trademarks without the express written consent of Orchid of Siam. Any unauthorized use terminates the permission or license granted by Orchid of Siam. You are granted a limited, revocable, and nonexclusive right to create a hyperlink to the home page of Orchid of Siam so long as the link does not portray Orchid of Siam, its affiliates, or their products or services in a false, misleading, derogatory, or otherwise offensive matter. You may not use any Orchid of Siam logo or other proprietary graphic or trademark as part of the link without express written permission.
ELECTRONIC COMMUNICATIONS
When you visit Orchid of Siam or send E-mails to us you consent to communicating with us electronically and agree that all such communications (including agreements, notices, disclosure, etc) satisfy all legal requirements to be in writing.
We will communicate with you by E-mail or by post, fax or telephone as necessary. If the Client does not respond to any communication related to the provision of the Service within two (2) working days, such failure will be deemed as the Client’s express consent to prepare the Service based on the information previously provided by the Client.
COPYRIGHT
All content included on this site, such as text, graphics, logos, button icons, images, audio clips, digital downloads, data compilations, and software, is the property of Orchid of Siam or its content suppliers and protected by English and international copyright and trademark laws. The compilation of all content on this site is the exclusive property of Orchid of Siam and protected by English and international copyright laws.
UK ONLINESPONSORSHIP FORM
This form is designed to gather information about you to assist in providing you with a personalized Service. As these questions may not be exhaustive we reserve the right to contact you for further or better particulars.
PROVISION OF SERVICE
By completing the Online Sponsorship form and making a purchase from Orchid of Siam the Service will be delivered to you within the time frame provided for in the Service description. However, in certain cases this may take longer, depending on the complexity of the Client's Profile.
The Service to be provided to the Client may vary from time to time.
The Client has the right not to complete the Online Sponsorship form and to provide the required information in writing by E-mail, post or fax. By making payment the Client expressly accepts that the Client has read, understood and agrees with these terms in their entirety.
PAYMENT OF SERVICE
Prior to providing any one of our Services you must pay the associated fees that are shown on our website.
This service fee does not cover the fee for the British Embassy to process a visa application. Please note that as Orchid of Siam are not in any way responsible for these fees you must pay them directly to the British Embassy and that they are subject to change without prior notice.
The Client must pay any postal or courier charges involved in ensuring that the documentary evidence required from the Client is supplied to the visa applicant in time.
All prices displayed and products and services offered by Orchid of Siam are subject to change without notice.
REFUND POLICY
As soon as payment is made, the Client is deemed to have engaged the Service of Orchid of Siam. Any request for a refund will be considered at the discretion of Orchid of Siam if your request is received prior to their commencing work on your case and within twenty-four (24) hours of the payment being processed. After this time however, please note that no refunds will be provided even if you are unable to apply for any visa(s) or the UK sponsor and/or the applicant decide not to continue with the application for any reason whatsoever. Once any work has been commenced on your case a refund will not be considered in any circumstances even if notice from the Client is received within 24 hours of the payment having been made.
All valid requests for refunds must be notified by E-mail within the specified 24 hour period. Any refund request addressed via another method or outside the specified period will not be considered.
Should we give you a refund an administration charge of £25.00 or 10% of the amount you have paid (whichever is higher) will be deducted from the initial payment in order to cover bank processing and administration fees.
GUARANTEE OF VISA OR WORK PERMIT
We are not part of the UK Government. We are a private firm and we do not have the authority to grant a visa or work permit of any kind. We can only assist and advise people who want to travel or migrate to the UK. Please note that the final decision on all visa applications rests with the Immigration & Nationality Directorate (IND) and on work permits with Work Permits (UK). Use of our services does not guarantee that a visa or work permit will be issued and Orchid of Siam will not be liable in anyway if a visa or work permit is not granted for any reason whatsoever. The Client is strongly advised not to book an airfare for the visa applicant until after confirmation that the visa has been successfully applied for and issued to the visa applicant. Orchid of Siam does not assume any liability for any injury or loss incurred by the Client in the event that the Client makes any form of travel arrangements against this advice.
INFORMATION PROVIDED BY THE CLIENT
Orchid of Siam will use and rely on information provided by the Client in the provision of the Service without having independently verified or assumed responsibility for the accuracy or completeness of such information. Accordingly, the information provided by the client must be correct, including contact details such as E-mail, etc. If the information provided by the Client is not correct, the Service may not be accurate.
Any advice provided to you should not be used by any third party as each case can vary depending on the particular circumstances of the applicant and their family. Such action will result in an immediate breach of our Copyright terms as set out above.
The Service also takes into account current and publicly available UK legislation and policy. Orchid of Siam cannot be held responsible for any inaccuracy arising from changes to such legislation and policy which are not publicly available at the time the Service is provided or which may occur after the Service has been provided to the Client.
The Client is encouraged to seek additional guidance or make independent enquiries before relying on the information provided as part of the Service.
In order to maintain professional integrity Orchid of Siam can only offer immigration advice and cannot offer any advice regarding taxation, business, education or investment. Any information provided by employees of Orchid of Siam on non-visa related matters should only be interpreted as general information and the Client should obtain professional advice regarding these matters.
TERMINATION OF SERVICE
Orchid of Siam reserves the right to terminate this agreement, and/or any other service provided to the Client by us for any reason, including any improper use of this site; provision of false or misleading information; or your failure to comply with these Terms.
DISPUTES
Any dispute related in any way to your visit to Orchid of Siam or service you purchase through Orchid of Siam shall be subject to the Laws of England. In any dispute the maximum liability of Orchid of Siam Bangkok shall be limited to the full amount actually paid by the Client.
In the event that you have in any manner violated or threatened to violate Orchid of Siam’s intellectual property rights, they may seek injunctive or other appropriate relief in court.
DISCLAIMER OF WARRANTIES AND LIMITATION OF LIABILITY
THIS SITE IS PROVIDED BY ORCHID OF SIAM ON AN "AS IS" AND "AS AVAILABLE" BASIS. ORCHID OF SIAM MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, AS TO THE OPERATION OF THIS SITE. YOU EXPRESSLY AGREE THAT YOUR USE OF THIS SITE IS AT YOUR SOLE RISK.
TO THE FULL EXTENT PERMISSIBLE BY APPLICABLE LAW, ORCHID OF SIAM DISCLAIMS ALL WARRANTIES. ORCHID OF SIAM DOES NOT WARRANT THAT THIS SITE, ITS SERVERS, OR E-MAIL SENT FROM ORCHID OF SIAM ARE FREE OF ERROR, VIRUSES OR OTHER HARMFUL COMPONENTS. ORCHID OF SIAM WILL NOT BE LIABLE FOR ANY DAMAGES OF ANY KIND ARISING FROM THE USE OF THIS SITE, INCLUDING, BUT NOT LIMITED TO DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, AND CONSEQUENTIAL DAMAGES.
To the extent that liability cannot be excluded, the liability of Orchid of Siam and their directors, officers, employees, and consultants is limited to the cost of the service provided to the Client as a maximum.
To the greatest extent possible by law, the Client must indemnify and hold harmless Orchid of Siam their officers, employees, agents and related companies (Indemnified Persons) against all Liabilities (including legal costs on a full indemnity basis) incurred by the Indemnified person in connection with the provision of the Service by Orchid of Siam except the Liability arising from the negligence or default of any of the Indemnified Persons.
GOVERNING LAW
The agreement Terms shall be governed by the laws of England.
GENERAL
No person has been authorized to give any representations on behalf of Orchid of Siam in regards to the subject matter or the terms of these Terms.
Headings in these Terms are for convenience only and do not affect the interpretation of these Terms.
Orchid of Siam may vary any of these Terms at any time and any other information relating to the Service, at any time and your subsequent use of the website will be governed by the varied Terms.
In the event that any of the provisions of these Terms are or shall become invalid, illegal or unenforceable, the remainder shall survive unaffected.
Due to privacy laws, we are unable to discuss your personal details with any third party enquiring on your behalf (including family) unless you provide your written consent authorizing us to do so.
Orchid of Siam reserves the right to decide which visa application forms to complete and submit to the British Embassy on behalf of the Client.
The Client accepts full responsibility for ensuring that any documentary evidence in support of a visa application is complete and in the possession of the visa applicant in time for the visa interview or submission of the application forms or as requested by the British Embassy.
+The services of Orchid of Siam terminate at the time of the initial consideration application by the Home Office or other relevant UK Government body or agency.
Any and all airfares, hotel, car hire or other travel arrangements offered or purchased via the website of Orchid of Siam are treated as contracts made with the companies offering the goods or services and not with Orchid of Siam. Orchid of Siam assumes no liability whatsoever for purchases made from these companies.
All information and advice given on the website of Orchid of Siam is given in good faith but readers are advised to take professional advice before acting upon the information or advice as Orchid of Siam assumes no liability whatsoever for any loss or injury incurred as a result of acting upon the information or advice given.
By using the website belonging to Orchid of Siam or buy purchasing any goods or services from Orchid of Siam you are deemed to be expressly stating that you have both read and understood these terms and conditions in their entirety and that you agree to be bound by them in all respects.

Complaints
In the unlikely event that you have reason to complain about the services provided to the Client by Orchid of Siam you are advised to address your complaint in writing by E-mail or recorded delivery post for the attention of Suthisa Kierans at the address shown on our contact page. Your complaint will be acknowledged within 24 hours and a full reply will be sent to you within 7 working days together with a suggested resolution. The Client has the right to complain about any immigration related matter to the Office of the Immigration Services Commissioner, 5th Floor, Counting House, 53 Tooley Street, London, SE12QN. |
