Today the Government announsed a plan to increase the NHS Surcharge by 100% as from a date to be annouced starting December 2018.
Within hours of Tony being interviewed by ITV Meridian for the news at 6 today the case in question has been immediately overturned by the Home Office and the visa issued immediately. This was a case where the Home Office refused a settlement visa for a wife by applying the incorrect rule. Tony was asked for his comments on this case.
Angela has now received authorisation from the OISC to work as a qualified immigration Adviser.

With effect from 6th April 2011 applications for Settlement as well as applications for British Citizenship are subject to a Criminality threshold. The length of sentence and the affect it will have on an application are as in the following table:

Sentence

Rehabilitation Period

A sentence of imprisonment or corrective training for a term exceeding 30 months or preventative detention or detention during Her Majesty’s pleasure or imprisonment or detention for public protection.

This will not become ‘spent.’

* Imprisonment or youth custody for 6 months to 30 months.

10 years.

* Imprisonment or youth custody up to 6 months.

7 years.

* Fine, community service/community punishment order or compensation order.

5 years.

Bind over, conditional discharge or supervision order.

1 year or when the order ceases to have effect, whichever is the later.

Absolute discharge.

6 months.

Driving disqualification.

Once the disqualification has ceased.

* All halved if the person is under 18 when convicted.
